Last updated

These Terms of Service ("Terms") govern your access to and use of THiNK+, including the THiNK+ application, website, THiNK+ Apps, and related services provided by Tech Innovators Network (THiNK) ("THiNK", "we", "us", or "our").

By creating an account or using THiNK+, you agree to these Terms. If you do not agree to these Terms, you should not use THiNK+.

1. About THiNK+

THiNK+ provides access to digital services, communities, content, applications, and other capabilities.

THiNK+ may allow you to:

  • Create and maintain an account.
  • Discover and interact with people and communities.
  • Access content and services.
  • Install or access THiNK+ Apps.
  • Participate in projects, tasks, events, and other activities.
  • Communicate or interact with other users.
  • Access services provided through participating THiNK+ Nodes.

The features available to you may vary depending on your location, account, node, installed Apps, or service configuration.

2. Your account

Some features require a THiNK+ account.

You agree to provide accurate information where required and to keep information associated with your account reasonably up to date.

You are responsible for maintaining the security of your account and authentication credentials and for activity conducted through your account.

If you believe your account has been compromised or used without authorization, contact us as soon as reasonably possible.

We may require additional verification for certain features or services.

3. Acceptable use

You must use THiNK+ lawfully and responsibly.

You must not use THiNK+ to:

  • Violate applicable laws or regulations.
  • Harass, threaten, intimidate, or abuse others.
  • Impersonate another person or misrepresent your identity in a deceptive manner.
  • Defraud, deceive, or deliberately mislead other users.
  • Distribute malware or interfere with the security or operation of the service.
  • Attempt to gain unauthorized access to accounts, systems, data, or services.
  • Circumvent access controls, security measures, or usage restrictions.
  • Collect or misuse another person's personal information without appropriate authorization.
  • Send spam or conduct abusive automated activity.
  • Exploit THiNK+ in a manner that could materially disrupt the service or other users.
  • Facilitate illegal, harmful, or exploitative activity.

Your use of community and social features is also subject to our Community Guidelines.

Child sexual abuse and exploitation (CSAE) and child sexual abuse material (CSAM) are strictly prohibited. See our Child Safety Standards.

4. Your content

You may be able to create, upload, submit, publish, or otherwise provide content through THiNK+.

You retain ownership of content that you own.

When you provide content through THiNK+, you grant THiNK the permissions reasonably necessary to host, store, process, transmit, display, reproduce, and otherwise handle that content for the purpose of operating and providing THiNK+ and the services you choose to use.

This permission does not transfer ownership of your content to THiNK.

You are responsible for ensuring that you have the necessary rights and permissions to provide content through THiNK+.

Different THiNK+ Apps, projects, research activities, or contribution programmes may have additional terms governing submitted material, datasets, intellectual property, licensing, attribution, or compensation. Where applicable, those terms will be presented separately.

5. THiNK+ Apps

THiNK+ may provide access to THiNK+ applications.

Individual Apps may have:

  • Additional eligibility requirements.
  • Additional terms or policies.
  • Specific permissions.
  • Participation rules.
  • Data collection requirements.
  • Incentives or compensation arrangements.
  • Content or contribution requirements.

Before participating in an activity requiring additional terms or consent, you may be asked to review and accept the relevant requirements.

Where additional terms conflict with these Terms in relation to a particular App or activity, the more specific terms will apply to that App or activity to the extent of the conflict.

Some Apps may be operated by organizations other than THiNK. Where this is the case, the operator may provide additional terms governing its service.

6. THiNK+ Nodes and network services

THiNK+ may connect to services provided through different THiNK+ Nodes.

Nodes may be associated with particular organizations, communities, countries, jurisdictions, or services and may be independently operated.

The availability of features, Apps, content, or services may therefore differ between nodes.

An independently operated node or service may impose additional terms, rules, or eligibility requirements. Where applicable, these should be presented in connection with that service.

Unless otherwise stated, these Terms govern your relationship with THiNK in connection with THiNK+ and do not create a contractual relationship between you and an independent THiNK+ Node operator.

7. Privacy

Our collection and use of personal information is described in the THiNK+ Privacy Policy.

Some Apps, nodes, or services may provide additional privacy notices or request additional permissions or consent where necessary for their functionality.

8. Community safety

We want THiNK+ to support constructive and safe participation.

We may provide mechanisms to report content, accounts, interactions, or other activity that may violate our policies.

We may investigate reports and take appropriate action, including:

  • Removing or restricting content.
  • Limiting access to features.
  • Suspending accounts.
  • Terminating accounts.
  • Taking measures to protect users or the service.
  • Referring matters to appropriate authorities where required or permitted by law.

We are not required to take a particular enforcement action solely because a report has been submitted.

9. Intellectual property

THiNK+, including software, branding, interfaces, designs, and materials owned by THiNK, may be protected by intellectual property laws.

Except where expressly permitted, these Terms do not grant you ownership of THiNK+ or THiNK's intellectual property.

You may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit protected elements of the service except where permitted by applicable law or an applicable licence.

Third-party and open-source software and content may be subject to separate licences and terms.

10. Feedback

If you provide suggestions, ideas, or other feedback about THiNK+, you permit THiNK to use that feedback to develop and improve its products and services without an obligation to compensate you.

This does not give THiNK ownership of unrelated content or intellectual property you submit through THiNK+.

11. Service availability and changes

THiNK+ is an evolving service.

We may add, modify, suspend, or discontinue features from time to time.

We may also perform maintenance or make changes necessary for security, reliability, legal compliance, or operation of the service.

Where reasonably practical, we will seek to avoid unnecessary disruption to users.

We do not guarantee that every feature, App, THiNK+ Node, or service will always be available.

12. Suspension and termination

You may stop using THiNK+ at any time.

You may request deletion of your account through our Account Deletion process.

THiNK may restrict, suspend, or terminate your access to THiNK+ where reasonably necessary, including when:

  • You materially or repeatedly violate these Terms or our policies.
  • Your account presents a security risk.
  • Your activity creates a risk of harm to other users.
  • We are required to do so by law.
  • Your account is involved in fraud, abuse, or serious misuse of the service.

Where appropriate, we may provide notice or an opportunity to address a violation. Serious safety, security, legal, or abuse concerns may require immediate action.

Sections of these Terms that by their nature should continue after termination will remain applicable.

13. Third-party and independently operated services

THiNK+ may contain links to, integrate with, or provide access to services operated by third parties or independent THiNK+ participants.

Your use of an independent service may be governed by that provider's own terms and policies.

THiNK does not control and is not responsible for the content, availability, policies, or practices of independently operated services, except to the extent responsibility cannot lawfully be excluded.

14. Disclaimers

We aim to provide reliable and useful services, but THiNK+ is provided on an "as available" basis.

To the extent permitted by applicable law, THiNK does not guarantee that the service will always be uninterrupted, error-free, secure, or suitable for every particular purpose.

Information available through THiNK+ may originate from users, Apps, THiNK+ Nodes, partners, public sources, or other third parties. Unless expressly stated otherwise, THiNK does not guarantee the accuracy or completeness of independently provided information.

Nothing in these Terms excludes warranties, guarantees, or other rights that cannot lawfully be excluded.

15. Limitation of liability

To the extent permitted by applicable law, Tech Innovators Network (THiNK) will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of or inability to use THiNK+.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

16. Changes to these Terms

We may update these Terms as THiNK+, our services, or applicable legal requirements evolve.

When we make material changes, we will update the date shown at the top of these Terms and provide additional notice where appropriate.

Your continued use of THiNK+ after updated Terms become effective constitutes acceptance of the updated Terms where permitted by applicable law.

If you do not agree to updated Terms, you may stop using THiNK+ and request deletion of your account.

17. Governing law

These Terms are governed by the laws applicable to Tech Innovators Network (THiNK), subject to any mandatory rights or protections available to you under the laws of your jurisdiction.

Additional jurisdiction-specific terms may apply to particular services or independently operated THiNK+ Nodes where necessary.
